2. Buyer

The individual or legal entity that opens an Otelka account and purchases a subscription (the “Buyer”). The Buyer’s billing details are those the Buyer enters on the subscription screen.

3. Subject of the agreement

The subject is the Otelka software subscription, consisting of the channel manager, booking engine and property website, identity reporting tools (the KBS list and notification file) and, if chosen by the Buyer, the front-office package (including automatic reporting with the Otelka KBS application). The scope of the service is described in the Terms of Service and on the pricing page. The service is provided online; there is no physical delivery.

4. Price and payment

  • The subscription fee depends on the plan determined by the property’s number of rooms and the chosen period (monthly or yearly); the front-office package is charged separately. The fee is shown clearly on the subscription screen at the time of purchase.
  • Prices are shown in euros (€) including VAT. Payment is taken in Turkish lira; the VAT-inclusive lira amount to be charged is shown separately on the payment screen, and this is the amount the Buyer approves.
  • Payment is collected automatically, monthly or yearly depending on the chosen period, from the Buyer’s card through the payment institution iyzico; card details are not seen or stored by Otelka.
  • When moving to a larger room tier or to the yearly period, the difference to be charged is shown on the payment screen and charged with the Buyer’s approval.
  • Opening an account and setting up are free; no payment is taken during the 14-day usage period that starts with the first reservation entry. A subscription is required to connect channels and to publish the booking engine and website.
  • Price changes are announced to the Buyer before they take effect and apply only to periods after the announcement.
  • An invoice is issued for the subscription fee and sent to the email address provided by the Buyer.

5. Term and renewal

The subscription runs monthly (30 days) or yearly (365 days) depending on the chosen period and renews automatically at the end of each period unless the Buyer cancels. The Buyer may cancel at any time on the subscription screen; cancellation stops the next period’s charge and the service remains available until the end of the paid period. Cancellation does not delete data.

6. Right of withdrawal

The service is provided to accommodation businesses acting for commercial or professional purposes; consumer protection rules do not apply to such buyers. Where the Buyer is a consumer, under the Turkish Distance Contracts Regulation the right of withdrawal cannot be exercised for services performed instantly online whose performance has started with the Buyer’s approval. As a way to evaluate the service before buying, Otelka offers free setup and a 14-day usage period. For the full cancellation and refund terms see the Cancellation and Refund Terms.

7. Performance

The subscription starts and the service becomes available as soon as the payment is approved. Activation of channel connections depends on the channels’ own approval processes. Access requires an internet connection and an up-to-date web browser; the identity reporting application also requires a compatible Windows or macOS computer.

8. Personal data

The parties’ rights and obligations regarding personal data are set out in the Personal Data Notice, the Privacy Policy and the Data Processing Agreement. For guests’ personal data the Buyer is the data controller and Otelka is the data processor.

9. Disputes

This agreement is governed by the laws of the Republic of Türkiye. Buyers who are consumers may apply, within the monetary limits, to the Consumer Arbitration Committees and Consumer Courts at their place of residence. For other disputes the courts and enforcement offices of the Republic of Türkiye have jurisdiction.

10. Entry into force

At the purchase step the Buyer declares that it has read and accepts this agreement and the pre-contract information. The agreement enters into force when the payment is completed. Questions: destek@otelka.com.
