Terms of Service
Last updated: 25 October 2026 · Version: 2026-10-25-v2
This English version is provided for convenience. If there is any inconsistency, the Turkish version prevails.
These terms govern the use of the Otelka software service provided by Otelka Yazılım (“Otelka”). By signing up for or using the service you accept these terms and the Data Processing Agreement, which forms an integral part of them. When you purchase a paid subscription, the Distance Sales Agreement also applies.
1. Definitions
- Otelka: the service provider whose details are listed in the company information below.
- Property: the accommodation business (individual or legal entity) that opens an Otelka account.
- User: the owner, managers and staff designated by the Property who use the account on its behalf.
- Service: the software provided at app.otelka.com, in the mobile web interface and in the Otelka KBS desktop application, including the modules listed in section 2.
- Channel: online travel agencies and sales platforms such as Booking.com, Expedia and Airbnb.
- Guest: persons who stay at, or make a reservation with, the Property.
2. Scope of the Service
Depending on the package chosen by the Property, the Service consists of the modules below. Which module belongs to which package is shown on the pricing page and in the application.
2.1 Channel manager
On the Property’s instruction and authority, Otelka connects the Property’s channel accounts to Otelka through the Channex connectivity platform. Through this connection Otelka sends the rates, availability and restrictions set by the Property to the channels, and receives reservations, modifications and cancellations, guest details, payment details to the extent shared by the channel, and guest messages. Card numbers remain in Channex’s secure environment; Otelka only receives summary data such as the card brand and last four digits. Channel account passwords are never given to Otelka.
2.2 Booking engine and property website
The Property’s own direct-booking page and a booking tool it can embed in its own website. For reservations made this way, the accommodation contract is concluded between the guest and the Property. The Property sets prices, cancellation and payment terms. Otelka does not collect payments from guests; payment is made directly to the Property by the method it chooses (payment at the property, bank transfer, etc.). These pages show guests a privacy notice generated by Otelka on behalf of the Property, using the Property’s details.
2.3 Front-office package
A paid add-on: check-in and check-out, guest records and identity details, room status and housekeeping, cash and company accounts, invoices, reports, guest messages from channels and automatic identity reporting with the Otelka KBS application. Invoices are issued with the Property’s own e-invoicing provider account and on the Property’s behalf; e-invoice/e-archive obligations rest with the Property.
2.4 Guest identity reporting (KBS) tools
The KBS list and a notification file that can be uploaded to the Police system are included in every plan. Automatic reporting with the Otelka KBS application installed on the Property’s own computer is part of the front-office package. Details are in section 5.
2.5 Reservation import by email (previous version)
For accounts using this method, reservation notification emails that the Property forwards to Otelka of its own accord, and files it uploads, are processed into the calendar. In this method Otelka does not connect to channels. The parties’ obligations for this setup are set out in the Data Processing Agreement.
3. Otelka’s role
Otelka is a software service provider. It does not provide accommodation, does not act as an intermediary in accommodation sales on the Property’s behalf, does not operate a marketplace listing properties and does not collect payments from guests. The Property’s contracts with the channels govern its relationship with them; Otelka is not a party to those contracts. Otelka does not claim to be an official partner or approved integration of the Turkish General Directorate of Security (Police), the Gendarmerie General Command or the channels.
4. Obligations of the Property
- The Property declares that it operates in compliance with the law and holds the required permits and certificates (such as a tourism operation certificate or a business licence). Otelka has no duty to verify these documents.
- It is authorised to connect and manage its channel accounts through Otelka and will comply with its contracts with the channels and with the channels’ rules.
- It is responsible for the accuracy of the rates, availability, restrictions, cancellation terms and property details it enters or approves in Otelka; these are what is sent to the channels.
- It regularly checks incoming reservations, the situation on the channels and the warnings in the application, and takes reasonable measures against the risk of overbooking. If it confirms opening occupied nights for sale in the application, it is itself responsible for any resulting double booking and its consequences.
- It is the data controller for guest data (section 6).
- It designates the users in its account and their permissions, and is responsible for keeping login details confidential and for actions taken through its account.
- Fulfilling its legal obligations such as guest identity reporting, invoicing and tax is the Property’s responsibility; the Service is a tool used for these obligations.
- It may not use the Service for unlawful purposes, in a way that infringes the rights of others or impairs the security or operation of the system. It may not copy or reverse-engineer the software or overload it with automated tools.
5. Guest identity reporting (KBS) and the Otelka KBS application
- Under the Turkish Identity Reporting Law No. 1774 and related legislation, the duty to report guests to the general law enforcement (Police or Gendarmerie) rests with the Property. Otelka’s KBS tools help the Property fulfil this duty; they do not take it over.
- The Police KBS system does not offer an integration interface open to software companies. The Otelka KBS application therefore reports from the Property’s own computer and with the Property’s own KBS user account, by repeating the steps a user would take on the KBS website. For properties reporting to the Gendarmerie KBS, a connection to the web service provided by the Gendarmerie is being prepared; until it is ready, these properties report manually in the Gendarmerie KBS. Changes, outages or access restrictions in public authorities’ systems may delay or prevent reporting; in that case Otelka may suspend the feature temporarily.
- The KBS username, password and two-step verification (EGM SEC) details are stored only on the Property’s computer, in the operating system’s encrypted key store; they are never sent to Otelka’s servers and cannot be seen by Otelka. With the “Authorise” step in the application, the Property consents to the two-step verification key being stored on that computer and to the application generating verification codes itself, and acknowledges that this step renews the existing device registration in KBS. The Property is responsible for the security of the computer and its user account.
- The Property checks pending and failed notifications in the KBS list every day, retries unsent records from the application or reports them manually in KBS. Liability arising from missing, incorrect or late reporting rests with the Property.
- The Otelka KBS application is licensed to the Property on a non-transferable, non-exclusive basis, for the term of the front-office package and only for its own property. The connection can be removed from Otelka or from the application; when the subscription or the front-office package ends or the connection is removed, the application can no longer send notifications.
6. Personal data
For guests’ personal data, the Property is the data controller; Otelka processes this data only on the Property’s behalf and instructions, as a data processor. Under Article 12 of the Turkish Personal Data Protection Law No. 6698 the parties are jointly responsible for data security; Otelka’s commitments are set out in the Data Processing Agreement. For account and user data Otelka is the data controller; details are in the Personal Data Notice and the Privacy Policy.
7. Fees, trial and subscription
- Opening an account and setting up are free. To get to know the Service, a 14-day usage period starting with the first reservation entry is provided, once per user. Connecting channels and publishing the booking engine and website require a paid subscription.
- The subscription fee depends on the plan determined by the property’s number of rooms and on the chosen period (monthly or yearly); the front-office package is charged separately. Current prices are shown on the pricing page and on the subscription screen.
- Prices are shown in euros (€) including VAT. Payment is collected in Turkish lira; the VAT-inclusive lira amount to be charged is shown separately on the payment screen.
- Payments are collected automatically at the start of each period from the Property’s saved card through the iyzico payment infrastructure. Card details never enter Otelka’s systems and are not stored by Otelka.
- If a payment fails, the Property is notified; if payment is not completed within 7 days of the end of the period, or the usage period ends, the account is closed to new entries and changes and the calendar cannot be viewed until payment is completed. During this time reservations from channels continue to be recorded and no notifications are sent to the Property; data is not deleted and export requests are fulfilled.
- Price changes are announced before they take effect and apply only to subsequent periods.
- Cancellation and refund terms are set out in the Cancellation and Refund Terms and the Distance Sales Agreement.
8. Service continuity and liability
- Otelka makes reasonable efforts to keep the Service running without interruption or error. Maintenance and outages or changes at infrastructure providers (hosting, Channex, the payment institution), at the channels and in public systems are beyond Otelka’s control.
- Synchronisation with channels may not be instantaneous. Channel processing times, updates rejected by a channel or changes made directly in a channel’s extranet may cause rate or availability differences or overbooking. Otelka shows delivery errors in the application and retries them; the Property is expected to follow these warnings.
- For reservation import by email (2.5), automatic reading alone does not guarantee completeness.
- Except in cases of intent or gross negligence, Otelka’s total liability is limited to the subscription fees paid by the Property in the 12 months before the event giving rise to the damage. Indirect damages, loss of profit, compensation claimed by channels or guests and administrative sanctions relating to the Property’s legal obligations are excluded.
9. Cancellation, suspension and termination
- The Property may cancel its subscription at any time on the subscription screen. Cancellation stops the next period’s charge; the Service remains available until the end of the paid period. When the period ends, the account is closed to new entries and changes; data is not deleted and can still be viewed and exported. Subscribing again resumes where the Property left off.
- The Property owner may request permanent closure of the account. The subscription ends immediately with the request; 30 days after the request the account and all data are permanently deleted, and the request can be withdrawn within this period.
- When the account is closed or the subscription ends, Otelka stops sending updates to the channels. Removing the connection in the channels’ own extranets or switching to another channel manager is the Property’s responsibility, as is uninstalling the Otelka KBS application from its computer and deleting any email forwarding rule set up for the previous version.
- Otelka may suspend or terminate the Service or a module in case of non-payment, breach of these terms, unlawful use or a security risk (for example suspicious use of a KBS application).
10. Intellectual property
The software, interface, documentation and the Otelka brand belong to Otelka; the Property is granted a right of use for the term of the subscription. Data entered into the Service by the Property belongs to the Property; Otelka processes it only to provide the Service, and the Property can export its data at any time with the application’s export tools.
11. Changes
Otelka may update these terms. Material changes are announced by email or in the application before they take effect. Continued use of the Service after the announcement means acceptance of the updated terms.
12. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of the Republic of Türkiye have jurisdiction over disputes.
